Going to the dentist is something that we all need to do from time to time.  Unfortunately, this is a medical field that tends to generate a lot of distrust because of the fact that they are working with such an intimate part of you, your mouth.  Not only that, but people love to tell stories about bad things that happened while they are in the dentist chair.  Let's face it, dentists are human the same as you and I and it times are prone to make mistakes.  If the doctor or the dentist is negligent, that mistake could end up in a dental malpractice suit that could cost them a lot of money.

There are several things about this type of a lawsuit, however, that you will need to take into consideration.  In the first place, the dentist must truly have been negligent while you are under his care.  Malpractice suits cannot typically be brought against the dentist whenever they make some kind of human error, you will have to prove that they were actually negligent.  This may be done in a number of different ways.  They may have mistreated you in some way which caused you harm, or it could be that they misdiagnosed your problem and treated you for the wrong thing altogether.  They may also have neglected to care for you whenever it was necessary and this may also fall under the same malpractice guidelines.

One of the first things that you should do if you feel that your dentist is guilty of negligence in one way or another is to hire a lawyer.  They will be able to look at your case in the light of all of the laws that are available in your area to see if you actually have a case of negligence or if it does not fall under that blanket.  If they feel that negligence is present, they may bring about a dental malpractice suit in order to get you some kind of compensation for your suffering.  Your dentist will receive news about this suit and will, no doubt, contact his own lawyers all with his insurance company to see what can be done to remedy the situation.  By the time the suit is actually filed, however, it is already a matter of public record and even if your dentist should happen to settle out of court it will remain on that record.

Nobody wants to go to court and for that reason dentist will typically settle out of court about 90% of the time.  Not only will this save them some of the money from a lawsuit, it will save them a lot in lawyers fees and is typically a decision which is financially sound on their part.  Just as you have insurance to take care of your medical needs, dentists and doctors will also carry malpractice insurance in case they are ever sued.  By bringing his negligence to light, not only will you be helping yourself to get compensated for your suffering you will help others to know that he was negligent and may steer them clear of troubles for themselves.
