The simple fact is, almost 90% of these hospital malpractice suits are never going to reach the courts.  The doctors realize that it is less expensive for them to settle out of court than to go through a long and expensive court battle that they will probably end up losing anyway.  Just as you have insurance, your doctor also is covered under malpractice insurance and they will typically be the ones that would advise him to settle out of court.  Even though nobody wants to sue for malpractice, sometimes it is just necessary because there is no other sort of recourse other than the legal recourse.  For this reason, hospital malpractice suits will continue to show up on the radar because people need to be compensated if their doctor is negligent.
